New Federal Regulations Established to Regulate Family Affairs under to Federal Decree-Law No. (41) of 2024 On the Issuance of the Personal Status Law
The Federal Judiciary Council has announced its approval of five new regulations related to Federal Decree-Law No. (41) of 2024 , in a move aimed at modernizing the family affairs system and unifying procedures across courts operating under the federal judicial authority.
The approved regulations address the organization of arbitrators’ duties, family guidance procedures, the execution of child visitation orders, as well as attestations, notarizations, and the rules governing the work of Sharia marriage officers (Ma’zouns).
These decisions focus on simplifying and accelerating procedures, enhancing digital services, strengthening the protection of minors, and promoting amicable solutions to family disputes, thereby ensuring greater efficiency and flexibility in judicial operations.
The package includes Regulation No. 66 of 2025, which sets the conditions and criteria for selecting arbitrators and outlines their role in examining marital disputes and submitting detailed reports to the court.
It also includes Regulation No. 67 of 2025 regarding family guidance, which grants family counselors broader powers to facilitate amicable settlements and gives agreements reached through this process the force of an executory instrument.
Additionally, the package includes Regulation No. 68 of 2025, which governs child visitation based on legal principles that prioritize the child’s comfort and psychological and social well-being.
Decision No. 69 of 2025 was likewise issued concerning attestations and notarizations, supporting the transition to electronic notarization, ensuring improved access to data, and enhancing reliability.
The set of decisions concludes with Regulation No. 70 of 2025 governing the work of Sharia marriage officers, defining the requirements for obtaining a license and the rules for digital marriage documentation, allowing contracts to be completed remotely.
By adopting these five regulations, the Federal Judiciary Council has established a clearer and more organized framework for managing family affairs in federal courts, while also strengthening the use of digital tools and improving mechanisms for amicable dispute resolution. This step represents a significant advancement toward building a more efficient judicial system that better responds to individuals’ needs, contributes to family stability, and supports justice in alignment with modern legislative developments.
